AGREEMENT BETWEEN USER AND SCC - SCC Terms of Use

About the Terms of Use

This page (together with the documents referred to on it) describes the Terms of Use under which you may make use of the Society of Cosmetic Chemists’ (SCC)  website www.scconline.org ("our sites") or application (“app”) as an unregistered or registered user. Please read these Terms of Use carefully before you start to use our sites or app. By using our sites or app, you indicate that you accept these Terms of Use and that you agree to abide by them. If you do not agree to these Terms of Use, please refrain from using our sites or app.

Section 1.  Accessing SCC’s Websites or App

Access to our sites or app is permitted on a temporary basis, and we reserve the right to withdraw or amend the services we provide without notice. We will not be liable if for any reason our sites or app is unavailable at any time or for any period.

From time to time, we may restrict access to some or all parts of our sites or app to users who have registered with us.

You are responsible for making all arrangements necessary for you to have access to our sites or app. You are also responsible for ensuring that any persons who access our sites or app through your devices are aware of these terms, and that they comply with them.

The sites or app contains a number of PDF (Portable Document Format) files. To download a document stored in this way you will need to ensure that the Adobe Acrobat Reader software is installed on your computer. You can download Adobe Acrobat Reader for free at www.adobe.com.

Our sites and app use cookies as part of its restricted access system. This cookie holds minimal information to uniquely identify you as a user.

We use Google Analytics to collect information about visitor behavior on our sites and app. Google Analytics stores information about what pages you visit, how long you are on the site, how you got here and what you click on. This Analytics data is collected via a JavaScript tag in the pages of our site and is not tied to personally identifiable information. We therefore do not collect or store your personal information (e.g. your name or address) so this information cannot be used to identify who you are. You can find out more about Google’s position on privacy as regards its analytics service at www.google.com/policies/privacy/.

Section 2.  Acceptable Use Policy

You may use our sites and app only for lawful purposes.

You may not use our sites and app:

  • In any way that breaches any applicable local, national, or international law or regulation.
  • In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
  • For the purpose of harming or attempting to harm minors in any way.
  • To harvest contact information or to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam).
  • To knowingly transmit any data, send or upload any material that contains viruses, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

You may not reproduce, duplicate, copy or re-sell any part of our sites or app in contravention of any of our Terms of Use.

You may not access without authority, interfere with, damage, or disrupt:

  • Any part of our sites or app;
  • Any equipment or network on which our sites or app are stored;
  • Any software used in the provision of our sites or app; or
  • Any equipment or network or software owned or used by any third party.

Section 3.  Interactive Services

We may from time to time provide interactive services on our sites or app.  Where we do provide any interactive services, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).

We will do our best to assess any possible risks for users from third parties when they use any interactive service provided on our site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our sites or app, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

Where we do moderate an interactive service, we will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.

Section 4.  Registered Users

If you choose, or you are provided with, a user ID, code, or password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user ID, code, or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms of Use.

Registered users may not use our sites or app to send, knowingly receive, upload, download, use, or re-use any material which does not comply with the following content standards.  These content standards apply to any and all material which you contribute to our sites and app (contributions), and to any interactive services associated with it.

You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any contribution as well as to its whole.

Contributions must:

  • Be accurate (where they state facts).
  • Be genuinely held (where they state opinions).
  • Comply with applicable US law and the laws of any country from which they are posted.

Contributions must not:

  • Infer or imply any endorsement by SCC.
  • Infringe upon any copyright or trademark of any other person.
  • Contain any material which is defamatory of any person.
  • Contain any material which is obscene, offensive, hateful, or inflammatory.
  • Promote sexually explicit material, violence, or discrimination of any type.
  • Be likely to deceive any person.
  • Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
  • Promote any illegal activity.
  • Be used to impersonate any person, or to misrepresent your identity or affiliation with any organization or person.
  • Advocate, promote, or assist any unlawful act.

Section 5.  Suspension and/or Termination

SCC reserves the right, in its sole discretion, to terminate your access to the SCC Web Site and the related services or any portion thereof at any time, without notice. We will determine, in our sole discretion, whether there has been a breach of these Terms of Use. When a breach of this policy has occurred, we may take any action we deem appropriate, including but not limited to:

  • Immediate, temporary, or permanent withdrawal of your right to use our sites or app.
  • Immediate, temporary, or permanent removal of any posting or material uploaded by you to our sites or app.
  • Issue a warning to you.
  • Initiating legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach, or other further legal action against you.
  • Disclosure of such information to law enforcement authorities as reasonably necessary.

Section 6.  Uploading Material to SCC’s Site

Whenever you make use of a feature that allows you to upload material to our sites or app, or to make contact with other members or users of our sites or app, you must comply with Sections 2 through 4. You warrant that any such contribution complies with those standards, and you indemnify us for any breach of that warranty.

Any material you upload to our sites or app will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our sites or app constitutes a violation of their intellectual property rights, or of their right to privacy.

We will not be responsible or liable to any third party for the content or accuracy of any materials posted by you or any other user of our sites or app.

We have the right to remove any material or posting you make on our sites or app if, in our opinion, such material does not comply with the content standards set out in Sections 2 through 4.

Section 7.  Intellectual Property Rights and Copyright

All contents of the SCC Web Site are: Copyright 2024 by Society of Cosmetic Chemists and/or its suppliers. All rights reserved.

SCC is the owner or licensee of all intellectual property rights in our sites and app, and in the material published on them (including the design, arrangement and look). These works are protected by copyright laws.  All such rights are reserved.

The “Society of Cosmetic Chemists,” “SCC,” “SCC NextGen,” and any related logos are some of our registered trademarks. Nothing contained in our sites or app shall give by implication or otherwise any right or license to anyone to use any of our trademarked works or related logos.

You must not modify any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

You must not use any part of the materials on our site for commercial purposes without obtaining a license to do so from SCC or our licensors.

Section 8.  Reliance on Information Posted

Materials posted on our sites or app are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our sites or app, or by anyone who may be informed of any of its contents.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES, HYPERLINKS, AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. SCC AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Section 9.  Changes to Our Site

We aim to update our sites and app regularly and may change the content at any time. If the need arises, we may suspend access to our sites or app, or close one or more indefinitely. Any of the material on our sites or app may be out of date at any given time, and we are under no obligation to update such material.

Section 10.  Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SCC AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SCC WEB SITES OR APP, WITH THE DELAY OR INABILITY TO USE THE SCC WEB SITES, APP, OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SCC WEB SITES OR APP, OR OTHERWISE ARISING OUT OF THE USE OF THE SCC WEB SITES OR APP, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF SCC OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

If you are dissatisfied with any portion of the sites or app, or with any of these Terms of Use, your sole and exclusive remedy is to discontinue using the sites and app.

Section 11.  Links to SCC

You may link to our home page, provided you give the SCC notice of such link by sending an e-mail to scc@scconline.org and provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part where none exists.

You must not establish a link from any website that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of our sites other than the home page. We reserve the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with the content standards set out in Section 2 through 4.

If you wish to make any use of material on our site other than that set out above, please address your request to scc@scconline.org.

Section 12.  Links to Third Party Sites

Our sites and app may provide links or automatically redirect you to third-party websites that are not controlled by SCC or governed by this Privacy Policy. For example, if you click on an advertisement or a link, you may be redirected to a website operated by that provider. These third-party websites may collect personal data and other data from or about you. SCC is not responsible for the content or privacy practices of any website that we do not control, and your interactions with such websites are governed solely by the privacy policies of the entity operating the websites, not this Privacy Policy.  We suggest that when you go to another website you carefully read their privacy policy.

Section 13.  Jurisdiction and Governing Law

The State of New York (USA) will have exclusive jurisdiction over any claim arising from, or related to, a visit to our sites or app; we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

These Terms of Use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of New York.

Use of the sites or app is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms of Use including, without limitation, this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and SCC as a result of use of the SCC Web Sites or app.  SCC's performance under these Terms is subject to existing laws and legal process, and nothing contained herein is in derogation of SCC's right to comply with governmental, court and law enforcement requests, or requirements relating to your use of the SCC Web Sites or app or information provided to or gathered by SCC with respect to such use. If any part of the Terms of Use is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above in Section 10, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms of Use shall continue in effect.

Section 14.  Revisions and Amendments

We may revise these Terms of Use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we have made, as they are binding on you. Some of the provisions contained in these Terms of Use may also be superseded by provisions or notices published elsewhere on our site.
